Copyright Infringement Notice & Takedown Policy (Papua New Guinea)

MoviesHaus ("we," "us," or "our") respects intellectual property rights and complies with the Copyright and Neighbouring Rights Act 2000 (Act No. 21 of 2000) of the Independent State of Papua New Guinea.

2 Filing a Copyright Takedown Notice

If you believe that material on our Service infringes your copyright under the Copyright and Neighbouring Rights Act 2000, you may submit a written notice containing substantially the following information:

  1. Your physical or electronic signature (or that of an authorised representative).
  2. Identification of the copyrighted work claimed to have been infringed. This may include:
    • Literary and artistic works
    • Musical works
    • Audiovisual works
    • Sound recordings
    • Computer programs
    • Expressions of folklore (group-oriented, tradition-based creations reflecting cultural identity)
  3. Identification of the infringing material to be removed or disabled, plus sufficient information to locate it (e.g., URL, page location).
  4. Your contact information – name, address, telephone number, and email address.
  5. A good faith statement that you believe the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement under penalty of perjury that the information in your notice is accurate and that you are authorised to act on behalf of the copyright owner.

3 What We Do After Receiving a Notice

Upon receiving a valid copyright notice, we will:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material, providing a copy of the notice and information about the counter-notification process.
  • Take reasonable steps to terminate, in appropriate circumstances, accounts of repeat infringers (see Section 6 below).

We typically process valid notices within 2–5 business days.

4 Counter-Notification Procedure

If your material was removed due to a copyright notice and you believe the removal was a mistake or misidentification, you may file a Counter-Notification.

Your counter-notification must be in writing and include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material removed and its location before removal (e.g., original URL).
  3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A consent statement to the jurisdiction of the National Court of Papua New Guinea, and that you will accept service of process from the original notifier or their agent.

5 After a Counter-Notification

We will forward a copy of your counter-notification to the original complainant.

Within 10–14 business days after receiving the counter-notification, we will restore the removed material unless the original copyright owner files a court action seeking an injunction against you. If we receive no such notice, we will typically restore the material.

6 Repeat Infringer Policy

We will, in appropriate circumstances, terminate accounts of users who are determined to be repeat infringers.

A "repeat infringer" generally includes any user who has received three (3) or more valid copyright takedown notices over a rolling 12-month period, unless counter-notifications resulted in restoration. We reserve the right to terminate at any time, even after a single egregious violation.

7 Criminal Offences Under PNG Law

Under Section 28(1) of the Copyright and Neighbouring Rights Act 2000, a person who infringes a protected right wilfully or by gross negligence and for profit-making purposes is guilty of an offence.

Penalty: Imprisonment for a term not exceeding ten (10) years or a fine not exceeding K100,000.00, or both.

We will cooperate with law enforcement authorities, including the Royal Papua New Guinea Constabulary, in investigating such criminal offences.

8 Folklore & Traditional Knowledge

Papua New Guinea's copyright law specifically protects expressions of folklore, including:

  • Folktales, folk poetry, and folk riddles
  • Folk songs and instrumental folk music
  • Folk dances and folk plays
  • Folk arts (drawings, paintings, carvings, sculptures, pottery, woodwork, metalware, jewellery, handicrafts, costumes, and indigenous textiles)

If you believe that an expression of folklore has been used without proper attribution or authorisation, you may submit a notice as described in Section 2.

9 Rights Management Information

Under the Copyright and Neighbouring Rights Act 2000, rights management information (RMi) includes any information that identifies the author, the work, the performer, the sound recording producer, or the terms and conditions of use. You may not knowingly remove or alter such information without authorisation.

10 False Claims

Any person who knowingly makes a false claim that content is infringing, or that content was removed by mistake, may be liable for damages (including costs and legal fees). Please consult your own attorney before submitting a notice or counter-notice.

11 Modifications to Policy

We may update this copyright policy at any time. Changes will be posted here with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
